Scottish version covers social housing, private tenancies and traveller sites run by RSLs

Awaab’s Law has today (Tuesday) come into force in Scotland.

Implemented through the Investigation and Commencement of Repair (Scotland) Regulations 2026, the law requires social and private landlords to address reports of damp and mould within fixed timeframes.

The new regulations, named after two-year old Awaab Ishak who died after exposure to black mould in a social home, are intended to ensure housing health and safety hazards are fixed promptly.

Scotland’s version of the law applies to secure tenancies, short secure tenancies, private residential tenancies and gypsy/traveller sites run by councils or registered social landlords.

From the date of complaint, Scottish landlords will have up to 10 working days to investigate, three days to provide findings following investigation and five days to commence repairs.

The first phase of Awaab’s Law was introduced in England in October 2025, with the next phase coming into effect on 30 November 2026.
